This is where all related topics regarding Measure 114 will take place. If you start a thread elsewhere it will not be moved here, it will be removed. We are having to babysit and deal with too many threads on this subject, so to have it all in one place it will be more manageable. Please adhere to the AUP. We know the topic is political, but it's important to our recreational choices as hunters and fishermen. This means keep it civil and on topic.

My last one was less a week to clear. It was a total impulse purchase.
I had the same impulse a week ago.
Went to get some lunch at Jersey Mikes and stopped by Ticklicker on the way not expecting to find much but found a gem (Colt King Cobra 357).
I hit the instant approve (4th time in a row) and was out the door in 10 minutes.
Instant approve is still possible folks.
Suppose to be an announcement from the Oregon Supreme court on this today.

What does that mean to English speakers? There are so many double negatives in the info that it's hard to figure out what this actually says. My interpretation, if I didn't lose track of reversals in logic, is the state supreme court rejected a request to override the Harney County judge's stay on implementation which would mean status quo continues. Yes? No?

You are correct. In essence, the OSC has chosen not to overrule because there has been no judgement by the lower court for them to rule on.
The same reasoning Judge Raschio used to implement the permit to purchase review - there is nothing yet in place to be reviewed so until it comes together, everyone sits and waits.

They denied the State's petition to vacate the stay issued by the trial court. The Supreme Court wants things to play out more naturally with actual arguments of merit based on the constitution. The state's petition did not address the merits and was an effort to just shut the case down. One has to ask why the State has a dog in this fight.

It's the responsibility of the Oregon Dept of Justice to defend laws passed by the Legislature including citizen initiatives.

In the court's words:

What I heard was this type of decision by the OSC happens when the law clearly says the measure being tossed is likely, on Oregon constitutional grounds.

The Oregon Supreme Court simply decided not to intervene at this time, and denied the writ of mandamus that the Oregon Attorney General was trying to get them to do to force the law to take effect now without waiting for the court process to play out. Meaning for now we wait for the lower courts process to play out over time, with the implementation of measure 114 still on hold pending results of the litigation.

I didn't see it posted in this thread yet, but the Oregon State Police added documents in one of the federal lawsuits clarifying that the FBI is refusing to implement their part of Measure 114 regarding the background checks for permit applicants. As the FBI has determined that Measure 114 violates Pub. L 92-544. Measure 114 was relying on the fingerprint process of the FBI background checks to allow OSP to issue permits to purchase a gun. So OSP will have to rely on their regular background check process, meaning yet another part of Measure 114 was poorly written.

I've seen that some gun dealers no longer sell to Oregon residents, same as California. All because some lunatic, decided it should be easier for a thug to buy a gun in Oregon, than a law abiding, tax paying citizen. Pretty pathetic......

That is true. Seeing that on some Gun Broker listings as well. "No sales to Oregon residents".

Check with your local gun shops.
There are some that are following the letter of the law and giving you your purchase after the 3 business days the BG checks are supposed to be completed in.
Online retailers are a bit more cautious but I was able to get some 20 round mags from one of the larger online retailers that were up on the facts.
I watched the pastor that was the lead sponsor of 114, he is appalled that the will of the voters is being held up. I guess he believes we live in a strict democracy? That dang Constitution thing is in the way. Maybe we should put a ballot measure in the next election to tax the men and women of the cloth 50% more in taxes, if they enter the political arena?

I think our school systems have failed us, where do these people come from, they have no awareness of how our laws are made and the rules they must follow.

The crazy thing is, a lot of people moved here from another state, and they bring their beliefs and votes with them. The irony is, that's why they left. They ruined the state they came from. If a person has a concealed carry license, there's no reason in the world why they shouldn't be approved instantly, totally ridiculous......

Most of the on line retailers who sell magazines with over 10 round capacity will ship to Oregon as there is no law against doing so. If you go on line check their shipping policy and you can easily see if that business will ship to Oregon.
Some new queue data. Ordered a new shotgun from Sportsman's today. Received a email a hour later stating ready for pickup. Went to pick it up. Even with my CHL permit I'm #10,003 in line. 25,000 total people in line for Oregon. OSP processing 2000 people per week they said.

Friday of last week OSP was processing applications from 12/8/2022 per my FFL. I was 10,500 in line with CHL, but got to pick my guns up today.

Now that the Oregon Supreme Court has decided (twice) to not intervene, Measure 114 is now blocked from being implemented until a full trial occurs in the state court system. The date for the trial has not been set yet. It will be months before a trial happens, and gets any resolution.
