Sorry to hear the news. My wife was rear-ended by someone without insurance and did eventually receive compensation.

You will have to sue the person that hit you. How much monetary compensation are we looking for? It is easier and less expensive if the case can be handled in small claims court. The limit in Oregon is $5,000. Is the person at fault a total loser or just a deadbeat? If the person at fault doesn't have two nickels, it will be difficult/impossible to collect but you should still sue him and receive a judgement incase some time down the line they win the lottery or something.

Don't let the ******* get off. Make sure he is fully prosecuted by the police and sue him and get your judgement. Who knows maybe someday he will inherit a little money or win the lottery and you will see something.

Exactly why does he think his problems are more important than yours? If you let him slide he will only continue on his path of destruction.
