This morning I got into an accident, not my fault. THe person at fault was driving with a suspended liscence and no insurance. My car looks like its a total loss and im not sure exactly what to do. Never been in this situation before. I only have liability, and cheap liability at that. Is there anything I can go through with the state or other avenues to help cover the cost of things? Maybe be compensated for a portion of my losses? Things would have just workedout better if it was a hit and run. Any information would be great. Im just a little dazed, [petunias!], and feeling a tad bit helpless right now about my current situation.

Sorry to hear the news. My wife was rear-ended by someone without insurance and did eventually receive compensation.

You will have to sue the person that hit you. How much monetary compensation are we looking for? It is easier and less expensive if the case can be handled in small claims court. The limit in Oregon is $5,000. Is the person at fault a total loser or just a deadbeat? If the person at fault doesn't have two nickels, it will be difficult/impossible to collect but you should still sue him and receive a judgement incase some time down the line they win the lottery or something.

I thought Oregon requires all insurance to add uninsured motorist to all policies. I call you agent and ask them for advice. That what they get paid for.

Your "Uninsured Motorist" coverage will usually cover the damage minus a deductible. Your insurance will then try to recover damages . You can then go after the deductible in small claims court against the person. A friend of mine had this happen in Washington State. The guy could not pay the award in Small Claims court. So in Washington state his drivers license is suspended until he pays the claim.

Call a attorney most will give you a free consultation on the phone. If you do have uninsured motorist your medical bills would be covered also if you were injured. Unfortunately I have been through this a few times and insurance companies will try and get over on people who don't know their rights. If you have a disability you may have to sue your own insurance company to collect but that is why you have uninsured motorist they step in just as if the other person had insurance. This my non profesional advice and it is worth every penny you paid for it. :cheers:

I am no expert on this so take it with a grain of sand,

wife is driving my pick up, she going to make a left hand turn, she in the turn lane, the guy next to her moceans to the gal in the parking lot to come out, "WAM" I get home and she tells me what happen, I call Farmers,(the Lady's ins co) when can I get my truck fixed, Agent says why?? I explain, I call the women, this is what I was told, by both.

I didn't run into anyone, who are you and don't call me again.

I had to sue Farmers, and the women, Truck fixed.

Than wife is in a parking lot, Meth head backs into her Subaru she and him exchange info, he says we don't need a cop, I well pay you on the 15th for the damage.
$450.00 out of my pocket, I call the druggie, no return call, I stooped by his house, I am not paying you or your wife, I went to the police station, he is now in jail,

Why is it so hard to run with the rules we all have to live with???

To drive, a license, Insurance, and capable.

I hope you can get your auto fixed or repaired, and for the person who hit you, Walking is good for yea.

Well i didnt have much time to focus on it since i work was really hectic. I will call my insurance company tomorrow. I dont believe I have uninsured motorist on my plan. All plans must include uninsured motorist for "BODILY DAMAGE". Luckily i do nothave any of that. I will do some more digging.

I called the guy and talked to him. I got the "oh i just went through a divorce, im broke, i spent my last bit of money on the car to get to my new job i started today, and i owe rent money, and i just moved here from Portland" story. So right now, its looking like im just going to have to take it as a loss. WHich is not making me very happy, and i just want to walk to his house and wring his neck. I just dont get it, my parents raise me to do the right things, follow the laws no matter how dumb i think they are. So here I am out insurance money, out a car, and out the value of my car. ALbeit it isnt that high, it is paid off and means the world to me and it was my first car. It definatley was in better condition than the blue book rated it, and ran like a dream.

I want to sue the guy, but you cant milk a dry cow. Just about the only thing I can do is think ill will upon him and give him the stink eye if i ever see him. I guess I just got a bad hand this week and have to deal with it. But man, it sure is going to suck for a while.

One thing you need to do is file the accident report. If the other driver was driving without a license and insurance he or she needs to be kept off the road.

Check you insurance policy and make sure you have uninsured motorist Property damage coverage on your policy. That is not always required but if you are insured with a preferred market it should be included on your policy.

Uninsured motorist=Pays for your bodily injuries.
Uninsured motorist Property damage= Pays for damage to your vehicle by an unisured driver.

Don't let the ******* get off. Make sure he is fully prosecuted by the police and sue him and get your judgement. Who knows maybe someday he will inherit a little money or win the lottery and you will see something.

Exactly why does he think his problems are more important than yours? If you let him slide he will only continue on his path of destruction.

On a side note, if anyone needs tires or rims i am totaling the car out tomorrow. If you would like to take a look at it and grab something off it PM me and i will give you my number and you can have it free of charge.

The tires are 2 months old, and the rims are American Racing.

Just let me know. The junkyard is gonna give me $0 for it. Oh well.. :shrug:

I will make sure they prosecute him to the maximum. But I just wish things would have gone a little better. I rather would have dealt with a real jerk with insurance than this guy. Maybe i should move to a nicer neighborhood.

Was this accident on the corner of 34th and oh, Marion (I believe) at the Circle K?
I had to do a run for milk this morning and there was a accident there that had just happend right as I was coming up 34th..
Just wondering, sorry to hear of what happend....
If I had some advice I would give it to you...

After reading my policy, i believe i only have uninsured motorist if my body was injured. I should have opted for better insurance, but live and learn. The guy is a deadbeat, probably wont see any money out of him for a long time. But ill think about it after I calm down, im still pretty ticked at the situation. The bad part is he only lives a few blocks away.

You are in a good position to keep an eye on him. When you see hime driving another rig turn him in or sue him and get the rig he is driving. Also you may want to up grade your insurance it probably would not cost that much to just add uninsured motorist that would cover your rig you don't need to have full coverage to have uninsured motorist coverage.
