Default Armed Trespass



I just heard that a duck hunter might have been arrested in the Klamath Falls area for “armed trespass”. I heard that his decoy weights were on the bottom of a non-navagatable stream and the landowner is pressing charges. I am trying to find more information on this. Has anyone heard of this? I was told it was in the last two weeks.

I believe Criminal Tresspass II is enhanced to Criminal Tresspass I when the tresspasser is armed.

Usually Criminal Tresspass I requires someone to tresspass on "protected property" ie; an occupied home.

Seems fair when applied to an armed thug but I don't think the spirit of the law really applies to duck hunters (my opinion)

i know of a couple of guys that i know a few years ago on lost river hunting high water line they were on a mud flat (river was low) and a lady came from here house to see what the banging was all about her house was a quite a distance off. she said that she was goin to call the cops and my friend said go ahead i will wait she did the both got criminal tresspass tickets (felony)
they fought it got lawyers and they won the river had been deemed navigable and the officer dident know it. so i can see how this could happen. i think i have heard about the one that you are refering to i think that thay were on the klamath river near gore island on the rat club but dont know details.

The Rat Club was one of the places I thought about. How can they get away with fencing off the river? I haven't found anything out about this one yet.

This stoy is kind of a bummer deal. At the Miller Island boat ramp, hunters ask an OSP about hunting in the Rat Club. He says no problem as long as they stay in the boat. Later the club manager and the same OSP show up and cite them because their decoy weights are on club property. One of those instances where they probably knew they were pushing the issue, but when the gamies say go for it, what are you to do. They are going to fight it tooth and nail.
