Default Whats up with the 2nd season spike elk pic?

What's up with the 2nd season spike elk pic? If you look in the picture up load file you can see what I'm talking about.
I don't know if anyone else has caught this but the picture is titled second season spike. The elk in the pic is clearly not a spike! Anyone know what's up?
I'm not trying to cause anyone any trouble here . I'm just confused. Is it missed titled?
Awhile back we had this discussion and someone added the pictures from ODFW and that cleared thing up for everyone.

Ok so I can't load a picture maybe someone else will.

Well... Here we go again, wow this thing needs to be resized. But near as I can tell, it is a spike on one side because it does not have a fork on the main beam above the ear that is longer than and inch, only below the ear. It appears to be branched on the other side but this would be a legal bull in a spike only unit, refer to definitions on the other thread. Read Mellow-Yellow or my final conclusions. Edit for image resize. Who's elk is this?

I'd be real afraid of having this head in camp, even if by definition it just qualifies.... I think?

Pretty ballzy to shoot that bad boy, looks like a spike to me.

During Spike only season up in Ukiah the gamies had a guy pulled over who had a raghorn STRAPPED TO THE TOP OF HIS TOLLBOX! Talk about not being the sharpest tool in the shed. I'm sure he "thought" he was legal.

Boy, did they have this bull tied up somewhere so they could measure that little branch above the tag. Looks pretty darn close to an inch in the photo. I agree, pretty ballzey to take that shot or very relieved when measuring it after the kill.

Legal by a fraction of an inch...........is still legal

Had a gamey stop in camp once and he advised after some Q & A, that if you have to measure that close he'd issue the ticket. Guess a day in court would be inevitable. I don't think I'd have taken that shot.

I thought it counted as a point if you could hang a ring on it?

In a spike only hunt I wouldn't have taken that shot. Might be legal but to close to call for me.

Maddies Daddy, in a spike only hunt the eyegaurds aren't counted.

Maddie read the above link that mello provided. A brow tine COUNTS for 3 pt. minimum areas, but NOT for spike only units.

From what I've seen, that is considered an illegal bull. The brow tine is O.K. but that fork above the tag is clearly a "branch" off the main beam. I personaly hunt in the Ukiah unit and know the local game officers in the area. I can bet you that if you were to have been checked you would have been issued a ticket. No doubt about it.

Please keep in mind that I'm not "you." I just posted the picture from the uploads, not sure who's it is. But, it's hard to tell by the picture, while that's definetely the start of a branch on the main beam, if it doesn't measure an inch to the closest part of the main beam it doesn't count. I'm thinking I'd have to have it with a tape measure to be sure, which is a good reason why I wouldn't have shot it. Three pt. min season, it woulda been a deader, not a spike season. Of course, we're not even sure this was shot in a spike season, it just says second season spike.

Heh, Heh...I just couldn't leave it alone. I took the liberty of editing that photo in hopes of clarifying things further. I sure hope it wasn't coypwrited.

What we have here is the perfect bull. Legal in the 3pt season, and legal in the spike only season.

Left side for 3pt...right for spike only.

I was waiting for someone to edit the photo, now we have a legal bull. Nice job mellow - yellow

The fisrt photo was not a legal bull for a spike season with the fork on the right antler.

Who is going to fess up with the real answer, was it shot during a spike season or not.

Like I wrote in the first post. I'm not trying to cause anyone any trouble here . I'm just confused. I have been on many a spike only hunt and have passed on several just for this reason.

I'm curios as to why the owner hasn't stepped up and said anything. Who is this mystery person.

I did not give any report to this story because I didn't think that the picture downloaded properly.
I guess it did.............

Here is the story.

It was Day #2 during the second season in the Starkey Unit. One of the guys in our party shot this bull in a clearing after it had run up a hill after being spooked by others in our party. The shot was approximately 100 yds.

When I arrived on the scene, after coming over a nearby hill, the shooter and another from our party had the gut sack out and it was pretty much cleaned. When I saw the rack I had a sick feeling and told them that there was no way this was legal.

We had some heavy duty debate on the hill and we finally decided that we had to take the animal back to camp, skin it and then face the music.

After hanging the elk and skinning, about an hour had passed and up pulled the State Police game officer. I just knew that we were toast! He asked to see the head and then he proceeded to discuss the "extra point."

About 15 minutes later, the regional fish and game man arrived and he proceeded to measure the point. He concluded that the point was approx. 15/16" of an inch in length. After discussion with the State officer they both concluded that this was a legal spike.

You can imagine our relief and extreme surprise. After the hunt when we returned home, one of our party did some checking on the official rule regarding this animal. As you know, it is legal to have a fork on one side but the other side is only supposed to have a spike.

The official rule that determined the legality of this animal was as follows from the Oregon Administrative Rules Div. 045...........

"Antler Point" is a point at least one inch in length measured from tip of point to nearest edge of beam. This definition applies only to the three-point elk and spike only elk bag limits.

When we were pronounced legal by the two officers, we celebrated with cold ones. It made for quite a memorable hunt. One that we will not forget for quite some time. We also learned something new about the "One inch Rule."

That is the story!!!!!!!

Great story, Rubber robin. I'm glad to finally see that a fish and game officer got it right. I know a few that would write a ticket anyway under those circumstances or chew you out over that 1/16th of an inch. Glad it all worked out for you - hope you have the rack mounted so you'll never forget how you felt that day!

Congrats.

Incidentally, I have to add this to the story.
When we were driving up to the Starkey Unit on Friday, we did our customary stop at Deadman's Pass rest stop. They always have an elk camp info station set up here every year.

They had a legal example of a spike that had 4pts on one side and a pure spike on the other. This would probably have been a bull that I would have passed on but would have been legal.

Oregon Administrative Rules as set by the Oregon Fish and Wildlife Commission (Aug 2003):

http://www.dfw.state.or.us/ODFWhtml/OARs/OARs.html

As stated previously, see "Antler Point" in "Division 045 Definitions". The definition is solely applicable to elk hunting.
