Default Sportcraft Marina!

I recently took my boat to Sportcraft Marina in Oregon City (under the I-205 Bridge) to have some work done on the engine. After 3 weeks in their lot, when I went to pick it up I noticed that the back seat was all busted up. After confronting the co-owner (Ryan Bigbee) of the marina and telling him that I did not drop my boat off in this condition, he assured me that his employees did not damage my seat and that the marina was not responsible for damage caused on their property. Needless to say I was pretty hot after this statement! This was after paying my $500 bill for the engine work and they wouldn't even cut me a deal once they saw what had happened. All they could tell me was that I needed to call my insurance company. Which I did and it'll be a $250 deductible to have it fixed. I decided a claim with the Oregon Better Business Bureau was in order and did so online.

I will certainly not be doing business with this marina ever again and I advise anyone else who uses this marina to find another alternative or proceed at your own risk!

Jim,
I sympathize with your situation. No one would want such a thing to happen to their boat. The marina should provide a secure environment for their client boats.

Interesting question for a lawyer, if they weren't so exspenive.
If a repair/service outlet post a sign disclaiming any responibility to damage done on the premises. Could that be so?
I would thing that if it could be proved, i.e. a pre inspection that they was no damamge to the vessel or vehicle when it was dropped off, then the propretior would then be liable for any and all damages done at their location.
Just because they say it, doesn't make it so.

Once they take possession of the boat it becomes their responsability; unless you sign something releasing them.

Contact the police and file a vandalisim report.

Also contact the State Attorney General and the State Insurance board.

Your insurance company will undoubtedly contact them for reimbursment if you file a claim.

If my memory serves me, don't they have a fenced lot for storage???

I've been through this myself with theft and damage resulting from the theft and the shops insurance had to cover it.

I believe Fishplay is right on. They are responsible if they take the boat into posession unless you signed something stating otherwise.

I'd bet about anything that you signed a release when you agreed to the service... check the fine print. I had a similar experience at another marina.

Ya, they had the standard disclaimer on the bottom of their work order absolving them from any liability. I highly doubt that would hold any water in court though. My insurance company didn't feel that it was in my best interest to take them to small claims cour though.
