Default Oregons\' Attorney General's report on navigability

For the very latest in the Navigability issue there is great news in the Oregon Attorney General's report on the legality of public use on Oregon's waterways. Those interested need to go to the Division of State Lands web site and check it all out.

When you get to the 33 page document by the Department of Justice go right to pages 27 and 28 for the meat of the subject. There are three more documents and I have printed it out for study. After nine years it's looking real good. We likely don't need any more legislation; especially anything that gives away public rights. Looks to me this only applies to navigable riverq, not the smaller coastal streams where the landowner's own the water beds. Most of these river in the upper areas have not been deemed navigable thus give ownership of the water beds to the landowners.

I'm not sure on the coastal river issue, but we badly need clarification on this issue and this opinion seems to have a lot of good in it for fishermen!

Sorry, this is exactly the streams they are talking about. If you can float it in a boat, "kayak", then it is navigible. This has been upheld by the highest courts in the land. This is also why there is such confusion.
