Default Gill nets

What are the rules concerning the use of the river? with my Foxy Fish just starting to work yesterday a large reel boat came up and layed out his Rake thirty yards off me stern ! I read all kinds of storys when they can fish and how they can fish. But what rule of living togather? If a drift river rake is coming down the slot do we have to move anchorage? Or stand our ground?

From past posts on this subject I believe if your anchored you can hold your ground and they have to work around you. I'll bet Pete know this one

I believe commercial vessels and working fishing boats have the right of way, whether anchored or not. If I remember, when I have some time later, I'll find the CG reg that applies.

Here are the rules out of Chapman. Vessels listed in order are the give way vessels.
1. Vessel not under command
2. Vessel restricted in it's ability to maneuver.
3. Vessel engeged in fishing.
4. Sailing vessel.
5. Power driven vessel.

5 must give way to 4, 4to 3 and on up the line. A fishing vessel, sport or commercial with lines out, trolling, is not considered to be a fishing vessel. Nets probably do make it a fishing vessel due to it's restricted ability to maneuver. An anchored power boat is not considered restricted in it's ability to maneuver. In any case it is foolish to play chicken with a 1000 foot gillnet drifting with the current. These nets can sweep up your anchor line and drive your boat underwater with little effort. Usually they will not set above an anchored boat. But there have been cases of boats anchoring in the fog below a drifting gillnet. Be careful.
