Default stolen truck

My truck was recently taken by my ex. This is the second time but with another vehicle. I have recovered the first vehicle, but it is no longer drivable.
A while back she got a bogus restraining order on me and "asked" for the car. She was denied and was promptly arrested after refusing to return it.
At the time she was pulled over the police made a judgement that the vehicle was indeed granted to her ( my papers say different).
Now that she has taken my truck the police refuse to act because they say they have been "burned" once already. "This is a civil case. "
Is it my responsibility to repair officers errors and authenticate the court papers given to me?....this is what they are telling me.

Dude, I feel for you. Im sorry things took a bad enough turn to leave you and your "x" on such terms. You should go to the court with papers showing proof of ownership and the the clerk should be able to straighten it out. If you still get no support, try the sherrif himself...Make an appointment. I think its out of a judges power to decide you have to surrender whats legitimately yours before a divorce or a hearing to allocate assets and property.

thanx for the reply....and by the way the wood splitter works great. We were never married.The police took it upon themselves to be judges and not enforcers of the law and an error was made by their hand..

Glad to hear your happy with the splitter.

As far as "divorce" is concerned, in the eyes of the law, when you live together and share bills etc, the courts see this as a "common law marriage" which means it takes at least a mediator, if not a judge to decide who gets what when you split and cant come to terms on your own. The good part is, if the vehicle was in your name, and registered to you, theres no way she can keep it if you dont want her to and theres no real legal grounds (marriage) for a judge to rule otherwise.

Now I am no lawyer, but had many of the same questions and a similar problem a few years ago...involved far more than a vehicle though!

again, good luck, I hope you dont have to hire a lawyer to help you out...might be cheaper to buy a new truck.

Talk to the court clerk and be nice about it...they can throw some weight around believe it or not.

One other simple suggestion, if you know where the truck is, call a wrecker, and show them the registration that is in your name (get a copy if its in the truck) and tell them it broke down and you need it towed home. Its a little white lie, but not unfair when dealing with your x if thats how she wants to play it.
