Default ZERO TOLERANCE on the Nestucca !

I just can't believe it, in all my years on the river! In the past couple weeks what I've had
the opportunity to witness with clients in the boat:

Incident #1

We’re on our second run of the day, late afternoon, coming into the top of a run before a
take-out. There is a boat near the tail out, about 100 yds downstream. As I look toward
the boat, I notice one man rowing, alone, and see TWO rods in the front rod holders!
Now, I can’t tell if the rods have line in the water, but as he approaches the tail out the
guy reels in the left rod, then reels in the right rod confirming the fact. There is a road
there next to the river and the guy doesn’t even look around! We fish the run, go down to
the next take-out and there’s the guy next to his boat. I row over, drop the hook right
next to his boat. We (my clients and I) sit there as the guy is fumbling around getting his
boat ready to pull out. Finally, he looks up and says “Oh, I didn’t see you there”. I say,
“We saw you though, with the two rods in the water”. The guy turns kinda pale, and
says, “You got me”. We have a nice conversation, I was very cordial, but I was also
convinced that I got the message across and won’t be seeing him do it again.

Incident #2

This past Saturday, I have 2 clients in the boat, we put in at daylight, heavy traffic on the
river, road next to the river again. I get into the third run of the day, come around a bend
and here’s two guys right in front of me with THREE rods deployed, and I can see the tips
dancing! I can’t frickin’ believe it!!! Twice in two weeks!?! I pull right next to them, tell
them it’s easier to row with your anchor not in the water (they had it a couple feet down,
making for a lot of drag trying to pull plugs). Then I ask them, “Why do you have three
rods in the water?” The oarsman’s reply, “Oh, we were testing this rod”. I tell them they
better pull up one of the others if they want to test one out! And tell them a few other
things in a very cordial manner, they comply and don’t have much else to say. I call in
their OR numbers and Trooper Coggins with OSP Game Division is waiting for them and
has a nice chat as well.

I’m not putting up with this anymore, if I see it, I am going to stop it and if I have to, I
will place subjects under citizens arrest until authorities arrive and subjects are cited.

What really bothers me is that if these guys are so blatant to do this, what’s to keep them
from doing other things like taking a few wild fish home for dinner as well???

Good for you Marty! I don't think there should be tolerance for breaking the rules anywhere. Ignorance is NO excuse for breaking the law.

Anytime a violation is witnessed, I say call the fuzz. They put the TIP line on you license/tag for a reason.

Suggestion:

I would not suggest this if you do not know what you are doing. If you do you need to be prepared for the worse. Most people do not know how citizens arrest works and I will almost guarantee you would have to detain that person who is extremely P*****D off because you are taking there freedom away. You will also most likely have to go to court. Are you prepared to do this? All I am saying is do not let your emotions control your actions. Be careful. If you do decide to do this make sure you know what violation the person is in. You need to tell the person you are placing them under citizens arrest and what it is for and the violation to make it clean. If you don't an attourny will eat you up in court. If you have to use force to detain make sure you do it right. It is not as easy as you think it is.

Your best bet is to call the OSP.

Thanks DS,

I happen to be very familiar with how citizens arrest works. I even have my own cuffs!
Many years ago before I started guiding I was in charge of loss prevention for a large
grocery chain. I’ve been there, done that!

And I will go the distance, not only that but will have witnesses as well! (As well as plenty of local back-up if need be )

I hope it won't come to that, but like I said, if I have to, I will.

I was fishing Sunday on a beach with 41 rods in site, so there was some confusion as to who's rods where who's if you didnt know the person. But anyhow I watched these guys about four rods down from me. There was two guys with three rods with the same looking rod holders so I was assuming they were fishing three rods but wasnt for sure. Anyhow they got ready to go and reeled in three rods put them in the truck and took off. Two guys not three. I guess since there was so many rods every 10 feet they thought no one would have noticed. I didnt know for sure until they left but still really bugs me. I cant believe people are willing to take a chance with so many people around. I am not the type of person to confront a person. But I do have my cell phone handy if I know for sure.

I am pursuing a degree in Fisheries and Wildlife, with a specialty in Law Enforcement for the same reasons you express. I am sick and tired of seeing so many people disrespecting both the resource(s) and others who use the resource(s).Now if we could only convince the state that they need to hire more troopers...I graduate in 3 weeks, but who knows if/when I may get a job

Also a question.........What if the center rod had no hooks on it.....like say it had a bright colored diver or a bare plug....Is that illegal?????\

Cap...... We were thinking it would push fish off to our plugs which are running 10 feet apart. thought it would fill in that gap. Just an idea......

I think the enforcement issue would be a problem and also think you would be cited for the extra rod, hook or no hook. How is a game officer going to know if it has a hook on the end without stopping you and checking it out. I think you'd be asking for it.

I know your are frustrated.. but I know the 2 guys in question on the second incident.. they would never knowingly fish an extra rod.. the so called third rod had a small hot n tot with no hooks on it .. Yes it was a bone head move on their part they should have reeled up a rod to test the third one but they didnt.. They were pulled over by the game cop that you called at third bridge, and he listend to what had happened he felt comfortable with their explanation of what had happend that he did not site the two for fishing with an extra rod.. yes there are trouble makers out in the world.. but those two are not the law breakers that you think they are. ..

At least in WA, it states in the rules you may not "use more than one LINE while fishing". No mention of whether a hook must be on it.

There's no definition for "fishing", but "angling" is described as "hook AND line fishing".

I'd say you'd be on shaky ground. Probably best not to test the waters.

Bubba911 points out the problem with citizen arrests. Laws are often misinterpreted or misunderstood. No one is very happy being accused of something by an officer of law, but they are even less happy being accused of something by someone who does not have any authority in the matter.

Citizen arrests often lead to violence. Keep in mind that your actions will not only lead to violence but that you can be sued(and should be IMO) if you are wrong or your actions are not warranted. I don't think the "IFISH River Patrol" is a very good idea.

Like I said if you really want to get the third degree from a game officer, go ahead and put out an extra rod with no hooks.

Some guys use extra rods for downriggers also, using just a heavy weight to get their gear down. Just be aware, you will get checked.

Stay on them Marty.personally I thought you were quite diplomatic with the first guy. Maybe if everyone started policing the ranks this problem could be resolved. If a person see's it happen and does nothing about it then in my oppinion you are a acomplice to the problem.{I will not say crime} It seems alot of what I have read on this subject people seem to be making some excuses for why someone would have a extra rod out. when really there is no reason for it. I am not sure that a citizen’s arrest would be lawful in this case. Although I could be wrong.

My understanding is that a citizen’s arrest is for crimes that a person could be arrested for without a warrant, typically a more serious felony. If you were to perform a citizens arrest on someone without due cause, you are in affect taking away their "liberties", and could be held liable. I know there are exceptions to this in the case of private property offenses (trespassing, theft, etc.) but I am not sure that having an extra rod in the water would hold up.

Again, I really have no in-depth knowledge of this area, and would be interested in hearing from others on this topic.

Just pull out your digital camera and take their picture. Make sure you get their boat numbers if they have them. At any rate, try to get a good enough picture to identify them.

The guys that were running the plug with no hooks should have reeled it in and shown as much. Otherwise I'm with Marty - if it looks like a duck and sounds like a duck....

I am thankful that there are people out there like you looking out for our interests.

It sounds like in incident #2 you had a nice chat with the gentlemen and it sounds like they complied. In a sense, you educated and they learned, and they gave some feedback on what they were doing as well. My problem is that you then called the State police. Why did you feel you needed to do this? I can see where this would be necessary if they told you to mind your own business or continued the poor behavior, but they didn't.

I wasn't there, and am not aware of the need for calling OSP, maybe you could explain?

The reason I called is because it just ate at me and ate at me being the second time in less than two weeks and I just decided I'm not putting up with it anymore. I didn't have them cited as I felt it was pretty well taken care of and having a chat with officer Coggins probably helped.

Listen, I don't want to be the river ranger of the Nestucca but I will turn in anyone I see doing any sort of illegal activity or violatiing our fish and game laws, always have and always will. If I have to I'll stop them, If I feel threatened I'll have the authorities waiting for them. It's pretty simple and straight forward. There's not too many places to run when you're in a driftboat floating down the river.

I just want to do my job and get along with everyone as I always have. And protect the great resource we have on the river that I call home.

I can appreciate that, I really can. I guess I was just wondering if it really did anybody any good. It also seems that maybe it took some valuable time that OSP could have spent working on other issues. I know we all complain about vehicle break-ins, thefts, snaggers, etc. If we can help lighten the load on OSP by policing ourselves some, as you did, they might be able to direct their energy's to the more pressing and serious concerns.

I'm not ripping on you at all here, just playing devils advocate. In fact, I have a lot of respect for the stance you are taking and commend you for a job well done.

Maybe we need to write up a "Drift Baters Etiquette" ( Spelling ) sheet and leave it at the Hebo store and the Guide shop. A few boaters ( including those silly one man pontoon things ) a just f ing clueless re bank anglers and where to pass another boat. Sorry to digress, just my lingering pet peeve since Sunday on the N.

FM, They do that on the Kenai. Guides who did not want to give away their hot spots would put out just the divers after catching their one fish

Anyone who went by saw all the rods out and kept on going. If you went by a boat with 4 anglers and one rod out you knew they were in the spot.

You can put out an extra line with no hooks if you want but ?????? why?

Should the state of Oregon issue permits for second rods?
It would probably raise a lot of much needed money for conservation.

Im glad there is someone out there that makes the day on the river so enjoyable and fun. Hope your as good a fisherman as you are a game warden. I just cant believe that there is no respect or trust for others anymore. I just dont know what to say, Im floored by all of this. Geez.

I had the pleasure of fishing Saturday as well, solo in a blue alumilite - saw and said hi as you and your clients passed by.

Anyway, there were three young guys rowing a 14ft db and they were running diver and bait! I couldn't believe it! I kindly reminded them that they weren't likely to hook ANY hatchery fish and that they were putting our wild fish in danger by using diver/bait but all that did was tick them off and they fished 'through' me for most of the rest of the day. I didn't get too ticked but it sucks to have those folks on the water.

This scares me Marty I think you did good and I think placing some one under citizens arrest is a very bad idea. I have seen folks go to the boat ramp and find broken windows slashed tires and more.When your dealing with them there kinda folks you dont know how many beers our what kinda idiot your dealin with. I just get the info and pass it on if they dont catch them today they'll get them tommarow.When we call up here it usally dosen't take Officer Oliver long to get there and its a lot safer.I under stand how you feel but please be safe I would hate to read that someone got hurt doing this.

Great job. How about taking photos of anybody fishing illegally and posting them on a board at Ron's store. "Have camera will fish and click" at those not abiding the rules.

Marty for President or at least Game Warden!!!

Thank you for always being considerate and friendly to everyone on the river. You could stand to be a bit nicer to me when I in your boat and I miss a hook up.

Where was the "river ranger" when I got my boat stuck a few weeks back? Actually you were on the same run but a couple hours ahead of me.

Went left instead of right at Tooney Creek and ended up in somebody's back yard.
