Default The crime spree .. a slight return

There has been a little adjustment at chez Pilar. I am in a leg brace awaiting an MRI, maybe surgery and will not be fishing or boating for some time. Things happen and people make **** out of it as a friend of mine often says.

This morning I woke to the sounds of a burglar or burglars in my home. I beleive they did not think I was home as I am often not home. Needless to say I skipped the early morning routine of stretching my old carcass before getting out of bed. I rolled out of bed and went for the living room. The perps bolted out the back door and before I could get outside they were on thier bikes and running down the street. Nonetheless I got a good look and I know who they are. This is the 4th time I have been violated this summer with 3 burglaries and a stolen car. In my heart I know it is these two kids but that is not good enough to convict or incarcerate them. This is the first time they have entered my home while I was there and I knew it was happening. I heard them break in and I saw them. I did not imagine it.

Anyway, I went back in quickly dressed and jumped in the car to give chase. Since I know these two little crank junkies I knew where to find them. Sure enough hiding under the trees at Essex park with bikes nearby ... there they were. I jumped out of the rig with murderous intent and fish bat in hand to chase them down and ... well I had not really given that much thought but I'm sure I would have landed in jail. The police are simply not interested in arresting and the system does not prosecute property criminals, especially those worthless pieces of crap that ride bikes and steal everything they can find to turn into Meth. They would be very happy to jail me a guy with property and money for assault or worse.

I got about 3 or 4 steps from the car at about warp 11 and went down hard. It felt like I had been hit in the back of the leg with a sledge hammer. Even thought I heard the blow.

The junkies escaped .. lucky for them.

I tried to stand and it seemed like my foot had fallen off and the ground under it was a hole instead of solid. Limping back to the car I went home and called the police.

This is the 3rd time I told them, it's time to do something about it. I will spare you the thrashing I gave the cop about the problem he would not solve.

So now I lack an achilles tendon on my left leg. It is blown and may take some time to recover. The trip on the black rocket is out and so is the rest of the fishing season 2003. Meanwhile Mr. Crankster is riding around on his bike feeling no consequences whatsoever.

Can someone explain the Karma of this whole deal to me. Is it ok for me to think of all the ways I would like to exact some retribution? Not act on it just think about it.

Move this if you will but the fishing content is Trip cancelled due to failure of the police to protect my property or prosecute those that would steal it.

Hey, Pilar, I was sorry to hear about your problems with the junkies. However, I wanted to tell you not to take any(thing) from the cops. Even though it would not be a very good case because you cannot show they actually stole anything, the kids still committed the crime of Burglary I (entering a dwelling with the intent to commit a crime therein-what explanation are they going to give for why they were in the house that would be consistent with a lawful reason to be there) or at the least, Criminal Trespass I. Provided that you could ID them such that they could be arrested, they should be prosecuted for either one of these two offenses. Of course, Burglary I is a Class A felony, which carries a max of 20 years. Good luck, but don't take any(thing) from the cops. Make them arrest these two.

I've gotta play mod on this one, guys. Not taking sides or doing any PC thing, just asking you to fix up your posts. Asterisks to cover cuss words need to be fixed with real words (that aren't cuss words) and Keta, maybe you can do a little tidying up as well.

John, that is beyond a bummer. That is an outrage, but it's lucky for all of us - you, and your brothers and sisters here - that you didn't catch them. I'd rather be buying boat jewelry than donating to your legal fund.

Let's see how this unfolds and we will find a way to help. Believe that!

Pilar, Those kids don't know how lucky they are. I support my fishing and hunting by selling insurance as a licensed agent.I think you are seriosly going to have to invest in a Alarm system for your House and Garage in order to have any peace of mind while you are away Carckin TUNA (it is all caps right?). Too many claims and you loose the insurance, do nothing different and they will watch and wait and return while you are away.My son at age seventeen and on drugs did a similar stupid thing and almost spent three years paying for it in prison. Now at twenty two he is in Bible College and begining to make his own way as an adult so I pray that these two will straighten up and leave you in peace. I know the anger and frustration you feel and after that goes away some resolve to make the walls of your Keep so hard to penetrate that all who consider it will realize the folly of such an effort. And, Yes I have alarms both at my Office building and at my home with no futher problems after they were installed. Email me if you want some Alarm vendors whom I trust. peace, Lee Powell

According to Larsen, that's one more reason why Second Amendment rights are vital to Americans' safety. He said he's relieved he didn't kill the man and he's equally relieved to know the suspect who broke into his home twice in one day is in jail.

So sorry to see your dream slowed down a bit. Don't give up! Maybe this will give you time to get all the leagleeze started for your licenses.

If you had caught those guys you may have been landlocked for quite some time.

Let us know what you need to get through this.

What kind of damage did they do breaking in?

How about welding up some window and door security bars while you're recuperating?

John, there was a reason this happened. If you had caught up with those kids, you may have done something very serious.

Under Oregon Law, a home owner can use deadly physical force to protect himself and his property INSIDE his home. The law recognizes that if a person forcibly enters a residence, it is reasonable for the home owner to feel his life endangered. In recent years the courts have allowed the extention of the use of physical force to the immediate area around their homes, ie, their yard and vehicles parked on their property.

A person is always authorized to use deadly physical force to protect themselves from any attack where the victim feels his life endangered.

To chase the kids out of the house, then go back and get dressed and pick up a bat and then go out and find the jerks is putting you on the wrong side of the law. You would have been prosecuted for assault if you used the bat on them and very seriously. If however you were effecting an arrest which you would have the authorization to do so, you could use reasonable force in effecting that arrest.

You I.D. the criminals and all you have to do is inform the police who they are and testify that you saw them inside your house. If the police do not persue their obligations, you have a course of action. That is you can go to their supervisor, the DA and you can even bring a civil suit against them for not doing their job. Believe me, their department would not want that to happen.

IF you need any info on how to proceed with the police, give me a jingle and I can tell you how to make things work.

Allow me to proffer a quick answer.

The police are obligated to take a report and pursue an investigation. (How diligent they will be is a subjective matter).

The sole determinant of a prosecution is the district attorney's or prosecutor's office.

No elected DA or prosecutor can live with the spectre of an individual doing a private prosecution. In most instances, they will pursue if they believe that the victim can and will consider a private prosecution.

These are the real facts. I have done this once, and have had another matter resolved in restitution and compromise as a result.

I am a former Federal Prosecutor. Knowing the lay of the land is more than half the battle.

Stolen cars are one thing. Entering my house with me or my wife home is another.
Meet Mr. Mossberg with 2 rounds of buckshot and then we get to the 1 oz slugs that leave a 1 inch hole in just about anything.

That is terrible!
I am so sorry you are hurt, and sorrier yet that you are the target of all of this!

It makes me emotional and angry just hearing about it!!!

Fish on, I am not an attorney, or police officer, so even I don't know if what you suggest is legal, or not.

Let's just leave all of the "what to do" or "what not to do" to Pilar, unless he asks for help, and support him in any way we can until then. Perhaps talk of what action might be best should be kept to e mail to avoid the ifish "PC" problem.

I do have to be careful of legalities, and I'm sorry for that. Just the way it is, and it's unfortunate, at times.

I am sorry to hear of your misfortune. An answer to your question about where is the Karma is... Those punks are going to die from the poisoning they are inflicting ou their bodies. Meth kills! (Quickly, I might add.) You will live to a ripe old age, fishing whenever you want. They will end up dead at 27, or 19. It's sad but they are wasting a life by committing suicide by drug abuse. I guess they are inflicting upon themselves what they deserve, because of the way they treat the rest of the world.

It sucks that you are one of their victims. Mend fast, and mend well. Big Blue awaits.

A torn Achilles is a injury that needs very skilled care. I just went throught this with my brother, a malpractice attorney, I can assure you he got good care.&lt;g&gt;

I don't have time to write a lot at the moment but;
IT'S CRUCIAL THAT YOU HAVE SURGERY TO REPAIR IT WITHIN THE FIRST DAYS AFTER INJURY.

Dang John. The Bad Luck Schleprock Syndrom has hit ya hard dude. Not sure which is worse, Jail or the leg. Jail may have been quicker.

Just keep o'l hickery by your side. Visit your local batting cage to keep up your swing. If o'l hickery is not close by then a 3 iron works pretty good. FOUR!!!!!!!!! That or keep a branding iron in the fire to make the criminal a marked man. [img]graemlins/idea.gif[/img]

Moved from Hillsboro to 117th and division about 10 years ago. Got robbed 3 times in less than a year. The first time was 3 days after we moved in. Couldnt change the environment and the cops could do little other than take a report, so I moved.

I"m really sorry to hear about this. That is a humdinger of an injury(I am an MRI Tech). I will however agree with Albacore Tuna Capt on this one. As much as I hate to hear about your injury, your incarceration would be tougher to stomach. Rest assured that crack heads seem to be strongly subject to the laws of Darwinism.

You will have some healing time ahead of you. Sounds like a perfect time to study for your 6-pack and develop a business plan for "Carkin' Charter Services". :grin: Take care.

Have you thought about moving? Granted with your leg the way it is, packing all your stuff into boxes is probably the last thing on your mind.
I don't see this thing continuing if they don't know where you are. I'm sure that if you wanted to move, there would be enough people on this board that would willingly donate a day of their time to help out.
To talk about karma for a bit here...
Here's how I see it...
Through pain, dificulty and strife we also grow. The old "what doesn't kill us makes us stronger" addage. You can also use the annalogy of the conception and birth of a child.
I also know the anger and rage you're experiencing my Bro-Bro. Yes, it certainly urks me on a basic level, that someone would knowingly risks their own lives for the thrill or money or whatever and upset the sanctity of anyone's home. Just the principle of it is enough to give someone a knuckle sandwich (mmmmmmm sannnndwiiiiiiiiiich...............)
On the other hand......
It's only stuff.......We are talking karma here right?
I'm thinking this crime spree stuff is targeted at you specifically because they know you, your habits, where you live and fact that you don't have any boobt-traps.
Perhaps reverse phycology is needed for this one. Perhaps they should be "invited" in and "welcomed." The Amish have been known to do this where "those English" burn down one of their barns. Once they are in your house???? Well...They are on your turf and the options are endless.
John, there's been a lot happening as of late and I see it as a sign.
My interpretaion is (1) You need to move out of that neighborhood. (2) This is an opportunity to meditate at the Temple. A chance to get right with you and your life. It seems that things are mighty wacky in the House of John these days and this is where you can clean out your "cupboards."
This is where you can to take a dip in the healing waters of Lake Me.
Your Creator is telling you something John. You've heard the calling now answer the door man.

As for those dirtbags doing this. They will soon end up dead on their own. It's a tragedy I know. They were probably good people once, but they aren't the same and never will be again. Crank cooks their brains, they don't think straight. They can't! These unfortunate soulless creatures will parish lonely and painfull demise. Possibly swiftly if they go to the wrong house apperantly.

John,

I went to be with my Brother before and for the first week after his Achilles surgery. As I said earlier he is a San Francisco malpractice attorney. He was able to consult with several of the physicians he uses as expert witnesses before making his decision on care.

They all strongly suggested surgery for the best chance at a trouble free future and only one period of recovery. The key to the first days post surgery is to ELEVATE the injured leg and to stay off your feet. This will require someone be there to chase down your every need. You are mobile but it's not something you want to plan on. You are going to be on crutches and here is the key point. You CANNOT put weight on this leg for 4-6 weeks after surgery. NONE, NADA! This means crutches and series of different casts. About this time physical therapy will start and you are on you way to total recovery.

You will need a shower chair, a good cast cover, crutches with pads. Sorry for the frank talk but I know you are a tough guy and can handle it. If I can answer any questions feel free to ask.

The very good news is that my brother is back to full functioning in about four months. Hang in there you will get through it.

John - What a bummer of a situation.

Perhaps there might be something good that comes out of this bad event. This time-out can provide a breather for you to consider your new career. Ya got lemons make some lemonade!

Be glad you didn't catch and cark those guys or you might have had a really long time-out.

I've been a little frustrated as of late and am looking for some releif and trolling is the best therapy I've found.

Everyone, thanks for the encouraging words. John will need them to keep his spirits up. He's going through classic "grief" right now and there's lots of bouncing around. I'm hoping to keep him focused on the positive as it will help the healing process.

Avid - Thanks for the advice. John will be waited on hand and foot for as long as he will allow (although he's at the office working right now :whazzup: ) Chez OB will be Chez Infirmary for a while, I'm guessing.

Maybe we can get Pilar started on that book, hmmm... (evil grin)

He thanked me and said he realized that it really made a huge difference in his recovery. Most importantly it allows time to develop the new perspective that is needed during the following weeks.

Above all else, John needs to keep it elevated. That means taking a TV stand or such to the office and using it. The less you elevate the more it swells, hurts and the slower the healing. It's not more complicated than that.

Sorry John, I think all of us have been violated at one time or another. If they would take just half of the revenuer traffic officers who almost outnumber the drivers on the road and make them protect our neighborhoods at night then maybe we wouldnt see this type of story.

I don't know if you are a bible man but something tells me that the someone has his hands on you. As per carma the bible says the rain falls on the just and the unjust.

Can you get any prints lifted from the house? Did you see them touch a jam etc that would be a good place to check. Finger prints plus your ID would make an undenieable case. Those boys need to be enrolled in a manditory state pen. detox center. They are a menace to society, you and themselves.

I have a friend who lives out on Foster Road. He has been robbed multiple times over that last year. He finally confronted them in the act. The only difference is he had a large revolver in his right hand. One of them ended up with a high energy trama piercing through his outer hip area when he tried to subdue my friend. The perps said that they were walking down the road and this guy invites them over and then proceeds to shoot them. The cops told him to shoot to kill next time. That way it is your word against the evidence not, your word against theirs. Though, someone with a rap sheet as long as thier arm doesn't have much credibility. BTW in the last year there has been 2 dirt bags killed and one wounded in the last 6 month in outer SE portland and those are just the ones I know of. All were clearly in self defense.

I am sure if those boys are dealt with, by the law, your robberies will stop.

Take care of that tendon John, you are going to need it. :smile:

Hey Avid - Trouble is, John has a great deal of pain when cold is applied. I'm having a hard time getting him to keep it iced and elevated. He's much more comfortable when sitting in a chair with the foot flat on the floor. Did your bro have the same experience? What to do?

Mr. Fisherman is kindly taking John to his Dr. Appt today. I'm tied up at the office (my boss actually expects some work out of me! )

Well for now, if that's what feels good then let it go and wait for advice from the doctor. My brother was in a soft boot for several days before his surgery. The doctor wanted it elevated to cut down the swelling before the surgery and then after as well. John's description of the sound he heard is quite diagnostic. Many/most refer to gunshot or bang at the time it happens. When I arrived on the scene to help my brother, two days after his accident, he wasn't doing much to care for the injury. He was heavily into dealing with the mental fallout of the whole issue. The worst part of an accident is the Oh, $%3# after it happens. Once my brother had his surgery things were on the upswing.

Kudos for Mr. Fisherman, John is going to need help for the next week+. With all the people John has helped I am sure it will be easy to line up some assistance. Remote control, snacks, beverages (easy on the Patron) fishing mags, USCG study materials all need to be close at hand.

Avid - Thanks. John seems to be handling the mental part well. I think we're prepared for the worst and hoping for the best in terms of prognosis. It looks like a 2-part injury so far, which is why he's having difficulty managing the pain (according to the x-ray tech). I'll sit tight and wait to hear what the doc says.

Meantime, I went out an purchased a remote control (I don't watch TV, so didn't bother with one), rented a bunch of movies and have created an office for John in the dining room. He's got some reading material and I'm planning on a trip to the bookstore tomorrow for more. He hasn't looked at the saltwater fishing catalog yet, though, so I'm a little worried :depressed:

Ya gotta have the remote. Lots of ballgames and news to keep you entertained. Maybe even the cooking channel. I had two back surgeries two years ago. My wife made a leash for the remote so that I could reel it in while recovering in bed. Best of luck with surgery and healing. You'll be better than new.
