Default Doh!

This was told to me by one of my partners. He took his friend and his wife out sturgeon fishing few days ago it was the wifes first time. They launched out of Toledo and went to their spot. They started fishing and talking. Tim asked them if they had remembered to get their shellfish tag because they were using mud shrimp. The husband had his but his wife didn't. So they pulled their rods and went back to the dock and the wife went into town to get her permit. So Tim decides to fish while he is waiting. The wife gets back dejected and says that the *** computer is down in Toledo. So Tim tells them to just go to Newport and get one and he'll wait. His friend and wife get back with the permit, coffee and donuts. Tim goes to use the restroom and as he is walking back to the boat he sees the wife reeling in his rod. He thinks they are just getting ready to launch but notices that the rod is bent and she is screaming. He gets to the 2 of them and watches her reel in a 45" fish. She tells him that as soon as he went in to the john the fish hit. That was the only fish of the day.

Were those mud shrimp purchased or pumped? If purchased, you don't need a shellfish permit. Now a hypothetical question. If i'm fishing with someone who has a shellfish permit, and I don't, can I use his sport-caught shrimp?

Permits/Lic. are for the taking, not the using of game etc. You can eat your buddies sport caught fish without a lic/tag can't you?

They were pumped. If they are store bought you must have the receipt from the store with you while you are fishing. If there are pumped/sport caught shrimp onboard all anglers must have a shellfish permit. At least that is how I interpretted the rule.

I think the friend that stayed with the boat probably thought they didn't need the shellfish license to have them for bait in the boat. But wanted the donuts and coffee and had to use the restroom because he wanted to laugh without being seen.
