Default Salmon out of Garibaldi?

Is it legal to go out of Garibaldi and run north of falcon, catch (optimism) salmon and then land them in Garibaldi? Do they need to be landed in 'legal water' or is it only important where they are actually caught.

Scott.

It's legal to do that in WA--I don't know about OR. What you absolutely can't do in WA is have hooks in the water if you're in a closed zone and have salmon on board, even if you're bottomfishing.

My understanding is that the port you land the fish is the port that sets the rules. Since Garibaldi is south of, then the assumption would be no salmons. But, I'm no game cop.

I can't cite you to any rules, but, if my memory is correct, last summer someone wrote about this issue and concluded that what matters is where you land the fish. So, a legal salmon caught north of Cape Falcon, if it really ever opens, but landed at Garibaldi, is not a legal fish. So, one would have to launch at a port that is opposite open water in order to legally land salmon there as long as the fish was truly caught in legally open water.

Kinda makes me wonder if the CR guys could run south and catch salmon, then land them up north. I suppose it doesn't really need to make sense. The rules are the rules.

That is correct. Except for the prevailing seas (NW), it would make sense to run to the fish. I know a few years where the CR crowd has fished with the Little Italy crew, but it is a bumpy ride home.

I do not know for sure about the rules TODAY but in the past the Garibaldi charters would run north for salmon when it was closed south of Falcon

I know this just adds to the confusion but that is what took place a few years ago
