Hey Nook your "hole" has signs posted on the south bank saying the following.
Private Bank Access
No tresspassing
No tying up to trees
No anchoring

We were hoping that someone would come out and tell we couldn't anchor there.

FW,
Fished Tidewater today with no luck. I did see a Chinook landed above the Hospital Hole before low slack but that was the only fish I saw caught all day.

Someone down here told me they heard the Trask hatchery already has there needed take of cohos. Can anyone verify that. They must hae crawld up on their bellies to get there. HOw has th tidewater bite been lately. Frog

If thats the case with the bait robbers then I'll go to a corkie and yard set up and plunk on the bottom. I got the report that the Hospital hole was slow last weekend. Where on the Trask does it say no anchoring up? Johnson's Bridge? I thought that as long as we're in the river we're ok? I think I'd have to tell the guy what he could do with his sign as long as we're in the river...

I am pretty sure the no anchoring sign is the two bit hole just above 5th street.

I would not be surprised if the hatchery had there fish. A couple weeks ago, I was down looking around and the river was full of silvers. It is quite a sight when the hatchery hole gets full of silvers.

Chinook fishing tends to make people a little crazy, not to mention possessive. But it sure is fun! Can't wait to start thowing bobbers, but for now it's the upper bay. Had a buddy once tell me that chinook fisherman are like elk hunters. Had to laugh and agree even though I'm both...

Just a few words about No trespassing..

According to federal laws It is impossible to tresspass in a floatable stream below the normal high water mark!!! Federal law states that all such areas are owned by the states to he "held in trust" for use by the public, It is illegal for states to sell or give away these rights. It's called rights to equal footing. There is no such thing as private property below the normal high water mark of a navigatable(sp?) stream regardless of what any deed might say.. State laws may vary but they do so illegally. Noone can keep you from tying up to a log, anchoring or even waalking aling the bank below the normal high water mark...
The federal law states that any river that can navigated in even small vessles (a canoe) is legal navagatable and therefore public access cannot be infringed upon below the normal high water mark. Our streams are not private property and we must exersize our rights to equal footing! It is NOT tresspassing. When land owners post these areas they are taking rights away from the public.
PS do not cross private lant to get to the river, do not go above the normal high water mark, be quiet and take out your trash

Before anyone goes out and tests rob allen's idea about what the law says, make sure you know a little more. Property owners whose property crosses the stream can own the stream bed. There are also other in-stream rights they may hold which could legitimately allow them to deny access. Further, until the navigability issue is adjudicated, it is not determined and local officials can pretty much do what they want, based on what they've done in the past. If you want to challenge a posted property, it's probably best to do it within the framework of the courts, cuz it's pretty hard to appeal a shotgun blast.

From a technical stand point all state laws are irrelivant as they are in themselves unlawful the only criteria for determining nagagability is can the river be navigated in basically any craft. If it is according to federal law it is public property held in trust for the specific purpose of public use for title purpose which includes recreation. All state laws prohibiting public use are illegal.
I agree though it is difficult to appeal a shot gun blast and someone still might be sited for tresspass wrongfully by local law enforcement.

I have personally had a few problems with a certain poperty owner on the Nestucca river the past few years. Most of you that fish the section of river below the mouth of Three Rivers regularly probably know who Im talking about. He owns the property on both sides of the river and believes he owns and controls the river bottom at the corner below the mouth of Three Rivers. I have been fishing it for a few years and every year he tryes to run us off but the first time he tried we imediately got on the phone with the State Police to be 100% sure of our rites. They informed us that the Nestucca river is considered navagatable and we have every rite to walk, boat, anchor, tie up a boat ect... which we already were 99% sure of.

I later found out that this man is very well known for being a **** to anyone that walks down or anchors up in the hole that BORDERS his property. I was told he even fakes taking pictures of the fishermen with a camera that has no film.
He took pictures of us fishing there last year so we took pictures of him taking pictures of us. He also drove down the river bank and spun his tires throwing rocks in the water to try and scare the fish away.

I can understand not wanting trash all over the river banks and tearing up someones property. But he did more damage to the river bank than all the fishermen that fish there do in a lifetime.

Now when ever he comes down he usually sees who we are and turns around to go home. We just wave and keep on fishing.

The one thing I know is we do have rites to access the navagatable waterways as long as we are below the normal high water mark. I was told that straight from the officers mouth.

My advice is be sure that you are fishing a river that is considered navagatable by the State and dont be a **** to the land owners just inform then that you know your rites. They may blow off a lil steam but if they do anything more than that you are now in the possition to be the one pressing charges and after they are cited a few times they might think twice about giving **** to the LEGAL fishermen.
