Default Question for landlords


Son call late last night, said the apartments where he lives is going to be made into condo's.

The reason I am asking you all here, is they gave him a 30 day termination notice, has to be out no later than the 23 of next month.

He don't have the bucks to move out, has some but not enough.

If the company has asked the renters to get out because of there wanting to convert to condo's, I wondering if he needs to pay next months rent there??????

Any help from you guys that have rentals.

Also he is on a month to month rental thing, no lease.

Yes, he does. Just like if he had given then 30 days notice. He still has to pay the rent.

It depends on how his rental agreement is worded. He probably paid first and last, plus a cleaning deposit. If so, he may not have to pay any more, and would get some or all of his deposit back.

Read the agreement.

No he paid first, & security deposit, no first & last.

Month to month is usually a "pay ahead" arrangement. Pay at the first of the month in which you live in the dwelling. So, it's very likely that, yes, he'll have to pay for the last month of rent if he did not pay first and last when he moved in. If he doesn't, that 30-day notice may turn into a 72 hour notice rather quickly.

If his rent is due on the the first then he should be able to pro-rate for only 23 days. Some formula like monthly rent x 12 / 365 x 23 = rent due... or to keep it simple, monthly rent / 30 x 23 = rent due.

I work for a general contractor who converts apartments to condos, tell your son to stay in contact with the new owner or there representative. If he needs something they are usually more than willing to help, espessialy if it helps him get out sooner, which is in both of their best interests. I have known the developers to "buy out" tenants by offering early move out incentives, great reference letters, extra time to move out if needed, even money for new rental deposits to u-haul trucks.
