Default Creek abuse

Just had a question.We recently sold our place and it has Lacumas creek running through the back 5 acres.The people that bought it are putting a cross fence up and running there bobcat right through the creek.Is this legal?It angers me this creek has a few kings and chum that spawn every few years a couple will wonder up this way.Who can I call to find out the deal here.not only that they cut some brush from beside the creek and threw it right in the water and let it float away!!!!TM

If you call the Dept. of Ecology, they can let you know if any laws are being broken. It's abuses like this that lead to new land-use restrictions. Let us know what you find out.

If you don't have any luck at the Dept. Of Ecology, call the Governor's Office in Salem. DO NOT settle for less. I know from experience it's tought to even get the State out to look at the problem much less enforce anything. Good Luck!!!

RCW 90.58.220
General penalty.
In addition to incurring civil liability under RCW 90.58.210, any person found to have wilfully engaged in activities on the shorelines of the state in violation of the provisions of this chapter or any of the master programs, rules, or regulations adopted pursuant thereto shall be guilty of a gross misdemeanor, and shall be punished by a fine of not less than twenty-five nor more than one thousand dollars or by imprisonment in the county jail for not more than ninety days, or by both such fine and imprisonment: PROVIDED, That the fine for the third and all subsequent violations in any five-year period shall be not less than five hundred nor more than ten thousand dollars: PROVIDED FURTHER, That fines for violations of RCW 90.58.550, or any rule adopted thereunder, shall be determined under RCW 90.58.560.

Locally we would sick the county dudes on them. So also try your local planning department and they can tell you if a permit was issued. Good luck

My mom had a problem with guys logging behind her. It's a very wet area and she knew she'd end up with the runoff. I told her to call the Dept of Natural Resources. They had someone out that day. Shut 'em down on the spot...no permit. I was impressed with the response time. Now if only the cops showed up that quick [img]images/icons/smile.gif[/img]

UPDATE-They came out yesterday and shut them down!!But I don't know if they gave them a fine or not...But guess what!! today they were back at it!!I called once again and they said that all construction should be haulted until the investigation was complete,,So I to be a RAT again...Time for something to be done.What a joke!! [img]images/icons/frown.gif[/img] The creek is full of mud.JUST LIKE WHEN I'M DONE CUTTIN TREES [img]images/icons/rolleyes.gif[/img] YEAH RIGHT!!!!!!

Some bozos back in 1998 changed the flow of the Mollala river and got busted big time. I'm glad to see you want to seek out help on this problem. I hope things work out to benefit the fishes return.
