Default Sandy River access

For those of you that didn't see the Oregonian article a few days ago, you should take a look at: http://www.oregonlive.com/news/oregonian/index.ssf?/news/oregonian/01/02/lc_62sandy 16.frame

The State Lands Division has made a recommendation that the Sandy River be declared navigable and the State should claim ownership of the river banks and bed. If this goes through then it will be excellent news for boaters and fishermen.
Sounds like a long process, though, with land owners along the river prepared to make a fight of it.

Excellent for some, not for others, I guess it is all where you are coming from.

I do agree a determination by the state would settle a long disputed topic. Of course we will have the state deciding if the state owns the land. Hmmmmm wonder if that can be done unbiased, I hope so.

Thanks for the post MikeT

For a short article it was fairly accurate. This will probably turn into a long drawn out process but should prove interesting.
Most likely they are going to have to go through this process for each river.

There is no private ownership of river banks on the Sandy up too? I guess that is what needs to be decided. We the people already own most rivers up to the normal flood line no matter what the deed says. The state just needs to say it boldly. I guess it is a good starting point for the gov. to get it's feet wet on an obvious case.

Even if the Grantor of the deed is the State of Oregon?
This is going to be a very interesting case and I hope if anybody sees any reference to this somewhere else they post it as MikeT did.
