Default Measure 37

Any 37 pros out there. I got 38 acres that have been in the family for 60 years but went in my name in 02. Does 37 allow to be transfered through the same family ownership. It is in Multnomah County. Any help would be great. I'm not looking for free legal ad. but I do want to know where to start or if I even can start.

Thanks: Torey

Yes and no. Great answer huh?
We just went through something similiar and there are alot of different scenerios. We ended up hiring an attorney. I suggest you do the same. It's not cut and dry, that's for sure. Make sure to hire an attorney familiar with 37 claims.

In our case, we were trying to break the land up into 1 acre lots. We ended up with 20 acre lots on part of it and 38 acre lots on the other portion. We also new the 1 acre lots were a longshot at best so we were happy with what we achieved. But do hire a lawyer. There is alot to these things.

I think that after the first of December, what ever you are considering doing with your property You have to go through a regular hearing process with the county/city commisioners and be turned down. Then file a claim under measure 37

I don't realy want to hire a attorney if I don't have a snowball's chance. I would think they might have a free first time visit.

the oregon state bar has a referral service. if you use their service to get the referral you only have to pay $35!! it has worked out well for me with my recent car sale dilema. the number is 1-800-452-7636

good luck

The Oregon State Bar's lawyer referral service is not a reliable way to find someone qualified to represent you in a measure 37 claim. Also, you are not likely to find a competent land use attorney that will give you a free consultation. However, someone familiar with m37 should be able to tell you your chances of success without spending much time. Given the potential value of your claim, you should invest in an hour with a qualified attorney.

I would be happy to give you a referral, but I don't know anyone practicing land use in Multnomah County.
