OFF ALERT 10/13/06
WASHINGTON COUNTY NOISE ORDINANCE THREATENS GUN OWNERS

While this alert is very last minute, it's important news for people
who live or shoot in Washington County.

Alert gun owners have made us aware of a proposed "noise control"
ordinance that may expose gun owners to civil liabilities.

The ordinance, which can be downloaded here
<http://oregonfirearms.org/pdfs/waconoise.pdf> proposes civil
penalties for a wide range of activities that produce sound at over 60
(dba) from 7am to 10 pm and over (50 dba) from 10pm to 7am.

Although the proposed rule includes a long list of exceptions, there is
NO exception for the lawful discharge of firearms.

Furthermore, any "private citizen may issue a notice of civil
infraction." Clearly the potential for abuse and harassment of gun
owners is tremendous.

Public comment is being accepted through today, Oct. 13th, but we
strongly urge that you make your concerns heard even if you receive
this alert after today.

Written comments may be sent to:
Heather Robinson
Washington County
Dept. of Health & Human Services
155 N. First Ave.,MS#4
Hillsboro, OR 97123
Fax: 503-846-4928

You may send e-mail to <noise@co.washington.or.us>

Keep in mind that politicians respond to constituents no matter what
"deadlines" are proposed. Please let Washington County know that you
want an unambiguous exception for lawful firearms' discharge.

Sounds typical. People move into an area that has been used for years as a hunting or target shooting area and feel that we need to stop.

Oh no! This is not good. Many Washington Co. residents have private gun ranges set up on thier property. Many duck ponds out there as well.....does that mean that if your neighbors get annoyed at your activities done on your property, that your in violation??? YES!

Better get tight w/ your neighbors!

My opinion.....if you don't like what your neighbors are doing out in the country, perhaps you shouldn't live out in the country. Kinda like complaining about the guy cutting hay next door because you have allergies.
Get over it...if guns and gunfire bother you, maybe you shouldn't live in the country. This is an ordinance best suited for the towns & cities....not the whole county.

Seems the county has forgotten about the Premption statute the legislature passed in the mid '90's. It does not allow for counties to regulate firearm useage. This is the same statute that ODF&W came up against. It always amazes me how the legal staff can conveintly forget about such laws.

Probably ought to make sure it's true (or at least partially) before you get too worked up over it...I was just wondering whether anyone had heard about it.

If it's unfounded, I'll scrub the thread...

I won't get too worked up, I live in Columbia County and it was my county commissioner that made notice of the premption statute a few years back, he said the county can not write firearm regulation laws, period.

Hey, I liked your article about the hunter abuse goin on during the seasons.
