yep another wolf thread
the feds are taxing our states big game herds by installing wolves in our states. i say we hunters are being taxed without representation. if the fedral governments wolves eat our states big game and do not compensate each states hunters for our loss of hunting oportunity, we hunters are being unduelly seperated out of the general population, to be taxed at a different rate than the general nonhunting population. and we get no voice in the extra taxation wolves put on our big game losses

it's hot down here in central california, so i'm using the california way of mind to poke a stick at a legal aurgument that has been stirring around in my head. taxation without legal representation? then on the other side of the coin: it has been proven in court that nonresident hunters are covered by the interstate commerce clause.if a state is forced to except wolves due to the endangered species act, this will force the state to reduce tag numbers, thus removing nonresident hunters from the state, hindering interstate commerce

Baltz, I love the idea but the only flaw is that the ninth circuit does not recognize recreational sport hunting as interstate commerce. The lawsuit in arizona about non-resident tag numbers only solidified the courts stance on sport hunting, so the only way the case was taken forward by USO was by two proffessional hunters suing because they sold the horns for a business and that was interstate commerce. Then congress passed legislation that reaffirmed the states rights to manage the states wildlife how they deemed fit,which threw out the 9th circuit ruling which was in favor of non-resident tag allotments.
Please correct me if there is something new.

you are correct, but a difference is the focus. in the arizona case and succeding cases it was an in state rights law. what i'm thinking is the wolf endangered species act is an out side the state force causing the hinderence of interstate commerce.each state has the right to pass and enforce game laws under the interstate commerce laws,the courts clarified this authority so the state should be able to pass laws to manage wolves with the same state authority

Even if your argument has merit, there isn't any way ODFW would take this on due to limited funding. And getting the state atty-general on board for this would be a tough sell too. Maybe a multi-state class action deal, but I wouldnt hold my breath. Not that I wouldn't like to see something done, but until there is actual losses being incurred (Oregon), there won't be any action.

probably just twisted california logic rubbing off. with lack of sleep thrown in for good measure. with lawyers, it probably has already been tried in court over the spotted owl, and been laughed out of court

Kind of off topic, but I saw a car from CA. at safeway today and it had vegan stickers and a preditor defense sticker and a peta sticker. I left them a strongly worded note to go home and don't come back. LOL I never did that before but I just couldn't take it anymore. LOL There I feel better now.

lack of good protien and essential ammino asid's aquired by eating meat will, in the long term, will thin out the vegans and their prodgeny. no need to disrespect them, they are already in full disrespect of them selves by their diet choice. if i'm hungry i will eat wolves and because i'm the lead predator on this planet, anytime i decide to do it i can
